1. Acceptance of Terms

By accessing or using DiscussionAI ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Service.

You represent and warrant that you are at least 18 years old. If you are not 18, you are prohibited from using the Service.

2. Nature of Service - Writing Assistance Tool

DiscussionAI is a writing assistance tool that uses artificial intelligence to help users brainstorm ideas, generate drafts, and improve their writing. The Service is designed as a learning aid and productivity tool.

THIS IS A TOOL, NOT A CHEATING SERVICE:

• The Service provides writing assistance similar to grammar checkers, outline generators, or writing tutors.
• Generated content is intended to inspire, guide, and assist your own writing process.
• Users are expected to review, edit, personalize, and add their own thoughts to any generated content.
• The Service does not encourage, endorse, or facilitate academic dishonesty, plagiarism, or policy violations.

No Guarantees: The Service does not guarantee accuracy, originality, compliance with academic standards, or suitability for any purpose. Generated content may contain errors, inaccuracies, or inappropriate suggestions.

You assume all responsibility and risk for how you use generated content.

3. User Responsibilities & Academic Integrity

You understand and agree that:

• You are solely responsible for how you use content generated by the Service.
• You must comply with your institution's academic integrity rules, honor codes, and policies.
• Generated content is provided for personal use, learning, brainstorming, and drafting only.
• You must review, edit, fact-check, and modify all content before using it.
• We do not endorse, encourage, or support academic misconduct, cheating, or submission of AI-generated text as original work.
• You assume all risk associated with academic use, consequences, detection, discipline, or penalties.
• DiscussionAI does not guarantee lower AI detection, plagiarism scores, or compliance with school policies.

4. AI Content Disclaimer

You acknowledge and agree that:

• AI-generated content may contain errors, inaccuracies, hallucinations, or nonsensical information.
• You must verify the accuracy of any generated content before using it.
• AI detection scores and plagiarism scores are estimates and may not be reliable.
• The Service makes no warranties regarding detectability, quality, correctness, or usefulness of generated content.

5. Acceptable Use Policy

DiscussionAI is a writing assistance tool comparable to Grammarly, Quillbot, Hemingway Editor, or Google Docs suggestions. Like these tools, it is designed to assist your writing, not replace it.

STRICTLY PROHIBITED: You agree NOT to use the Service to:

• Submit AI-generated content as your own original work without proper disclosure, review, or modification
• Engage in academic dishonesty, cheating, or violate your institution's academic integrity policies
• Circumvent, manipulate, or interfere with plagiarism or AI detection systems
• Use the Service in any way that violates your school's honor code, student handbook, or course syllabi
• Generate harmful, abusive, illegal, defamatory, or unlawful content
• Exploit minors, facilitate crimes, or create material that violates any law
• Reverse engineer, scrape, or extract data from the Service
• Attempt to access systems without authorization
• Use automated tools, bots, scrapers, or scripts to abuse the Service
• Resell or commercially exploit the Service without written permission
• Interfere with Service performance, security, or infrastructure

Violation of this policy may result in immediate account termination without refund or notice. We reserve the right to report serious violations to appropriate authorities or institutions.

6. Subscription, Billing, and Payments

• Monthly Subscription: $14/month, auto-renews until canceled.
• Semester Pass: $39, one-time payment for 4 months, does NOT auto-renew.

Payments are processed securely through Stripe.

By subscribing, you authorize recurring charges for monthly subscriptions.

You may cancel anytime; access continues through the end of your billing period.

7. Refund Policy

All purchases are final and non-refundable.

We do not offer refunds for subscription fees, one-time payments, or unused time on a subscription.

We reserve the right—but are not obligated—to issue refunds only when required by applicable law.

8. Usage Limits

All plans include 10 generations per day, resetting every 24 hours.

Abuse of usage limits may result in temporary or permanent account suspension.

9. Account Termination

We may suspend or terminate your account, with or without notice, for:

• Violating these Terms
• Academic misconduct
• Fraudulent or suspicious activity
• Abuse of the Service
• Chargebacks
• Threats or harassment toward staff or users

You may terminate your account by canceling your subscription or contacting support.

10. No Warranty

The Service is provided "as is" and "as available", without warranties of any kind, express or implied.

We do not warrant that:

• The Service will be error-free or uninterrupted
• Generated content will be accurate or reliable
• AI detection tools will perform as expected
• Academic institutions will accept your use of the Service

11. Limitation of Liability

To the fullest extent permitted by Florida law:

• DiscussionAI is not liable for academic consequences, disciplinary actions, lost grades, failed courses, or institutional penalties.
• DiscussionAI is not responsible for damages arising from the use or inability to use the Service.
• In no event will our total liability exceed the amount you paid in the 1 month immediately preceding the claim.
• This limitation applies to all claims, including negligence, product liability, tort, and contract law.

12. User Indemnification

You agree to indemnify, defend, and hold harmless DiscussionAI and its owners, employees, contractors, and affiliates from any claims, damages, losses, liabilities, or legal fees arising out of:

• Your use of the Service
• Academic disputes or disciplinary actions
• Violation of these Terms
• Misuse of generated content
• Legal claims involving your content or actions

13. Intellectual Property

You retain ownership of your inputs (prompts, text, files).

DiscussionAI grants you a license to use the generated output.

The Service, including all software, design, branding, and proprietary systems, remains the exclusive property of DiscussionAI.

You may not copy, distribute, or reproduce the Service.

14. Privacy

Your use of the Service is also governed by our Privacy Policy (published separately).

Use of the Service requires acceptance of that policy.

15. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

16. Binding Arbitration & No Class Action

To the fullest extent permitted by law:

• Any dispute between you and DiscussionAI will be resolved through binding arbitration in Florida, USA.
• You waive the right to participate in a class-action lawsuit.
• You waive the right to a jury trial.

17. Changes to the Terms

We may update these Terms at any time.

Material changes will be communicated via email or through the Service.

Continued use of the Service constitutes acceptance of updated Terms.
